At least he got to keep his guns. Here in MA, if you lose your permit, you can't own *anything* of the boomstick variety, at least not a handgun or semi-auto rifle with a capacity of > 10 rounds.
And permits have been refused for reasons even pettier than those in the linked article...
As Bram said, Shall Issue" is better than "May Issue"... Because "May Issue" means "Won't Issue" here in CA. But we're still better off than JayG's permitting process in MA. My Handgun Safety Certificate card can and will expire, but it's just for at-the-time-of purchasing, not ownership.
I did my part here in Iowa to get the shall issue bill passed (pause to pat myself on back) called all my elected officials, wrote many letters. My county happens to be shall-issue, but I knew I was a heartbeat away from a new sheriff in town, and his new ideas. Moved here from Maryland, where Mr. Frosh, personal friend of the Bradys, will die before he lets a pro-gun bill out of Judicial comitee, which he chairs. Spit.
NJ essentially has won't-issue, but there's no paperwork to lift once you've purchased, either. Short of becoming a prohibited person, I can keep my heaters till doomsday (and almost any I obtained prior to landing in Mordor on the Hudson South are mine to keep as well).
For that matter, the purchase paperwork is shall-issue (even if the NJ Supreme court can't count to 30 on a calendar). NJ, we can't even be #1 in sucky gun laws...
I submitted my CCW paperwork to the local LE' four months ago. Follow up call informed me that " We only review these applications twice a year, and if you pass muster, we will call you in for an interview." At that time I will pay $160 and still wait for judgement from a commitee of cops. The 'why' criteria won't fly if it's for personal protection. Only if 1. Your connected. 2. You carry large sums of cash. 3.You can document a threat. My wife and I are looking at property in Scotsdale, Az.
I understand that in NJ, while "carrying a lot of cash" is a viable reason, the permit is issued to be only valid *while you are carrying lots of cash*. The issuing judge can put whatever restriction he pleases on the permit. I also understand that there was a case where a bail-bondsman needed a permit to carry for advancement in his job, and was denied ont eh grounds that he could get a different job...
It's at the discretion of the judge - county judge I believe. A friend of mine claims that he knew a guy who got one becuase that guy regularly deposited $500 in cash in the bank. Not surprising, my friend was from Wildwood and all those boardwalk businesses are heavily cash sales, and very important to the local economy.
Self-defense is explicitly not a "valid reason" based on a whole slew of court decisions including one from just before MacDonald.
If you are caught with hollowpoints in your ccw in NJ, the fine is $1000 per round in the gun, and on your person. Ok in your home, though. I believe the po-po are authorized for those nasty boolits.
Wildwood. Don't know if it's still operating, but there was a PT Boat docked right at the end of Otten's(?) Harbor. Right up against Wildwood Blvd. When the tide was high, from the streets it appeared that it was grounded on the street. It was used for scenic tours around the island. FAST tours :-) IIRC, the original Alison v-12 aircraft type engines had been swapped out for something less maintenance intensive. Still had a nice throaty rumble/purr. Sounded pretty close to what you hear in movies and tv.

That's a nice precedent to set for the State of Iowa.

I can't wait till 1-1-11 to renew change out my neutered permit for the real deal.
ReplyDeletePut that in you pipe and smoke it Mr. Sheriff.
It will be soooo hard not to thumb my nose at my sheriff as I head out the door.
Shall Issue" is better than "May Issue"... Beacause "May Issue" means "Won't Issue" here in NJ.
ReplyDeleteTwo decades back when I lived in Iowa, I put on a tie and stopped by to ask my sheriff for a CCW.
ReplyDeleteHe laughed in my face.
I moved.
I tend to prefer "No Need To Issue", such as openly recognized by Alaska, Vermont, Arizona, etc.

ReplyDeleteI prefer a million dollars to show up on my front lawn, but as it turns out, I'm gonna go need to earn it a buck at a time.

ReplyDeleteOne of these days...
I knew a guy who had an NJ CCW; he worked for his folks' mortgage company.
